Case Notes: Client was an undocumented immigrant receiving immigration benefits under Deferred Action for Childhood Arrivals (“DACA”). A DUI conviction would legally preclude Client from receiving DACA benefits any longer, and could have resulted in possible deportation.

Disposition: Reduced. After negotiation with the prosecutor, The Tang Firm gets the Client’s DUI charges reduced to a minor misdemeanor violation of “Exhibition of Speed” resulting in Client being able to continue to receive immigration benefits under DACA.

DMV APS (DUI) Hearing Result

Case Notes: DMV moves to suspend Client’s license after Client was arrested for DUI and alleged to have refused to provide an implied consent chemical breath test (he was alleged to have refused to blow into the breath machine after being arrested). Since this was the Client’s second DUI arrest, Client was facing a two year hard suspension of his license without the option of a restricted license.

Result: Suspension prevented. After a contested hearing on the merits in which the officer’s testimony was taken in person, The Tang Firm gets the DMV to set aside their suspension, and the Client’s license is reinstated. The Client avoids a two year license suspension.

Case Notes: Client was arrested by undercover police attempting to sell 80 tabs of Hyrdocodone (AKA Norco, Vicodin).

Disposition: After negotiation, prosecutor dismisses the transportation charge and downgrades the possession for sale and then agrees to give Client DEJ (deferred entry of judgment). The charge and entire case against Client is subsequently dismissed. Client does no jail and suffers no conviction on his criminal record.

Personal Injury Case Result

Damages Award Received: Over $19,000.

Case Notes: Client’s car was broadsided by another vehicle in a low speed collision at an intersection. Ambulance was not called, however Client experienced back and neck pain after the collision.

Disposition: After negotiation, the driver of the other vehicle was found to be liable and the Client was awarded $19,387 in damages.

Criminal Case Result

Client arrested for: DUI (LA County), and DUI (Orange County).

Case Notes: Client was arrested for DUI in LA County. During the pendency of that case, client was subsequently arrested for a second DUI in Orange County. A second DUI conviction in California carries minimum mandatory jail time and a significantly harsher DUI school punishment.

Disposition: After negotiation, I had Client plead to a Wet/Reckless in LA county. On the same day, I was also in Orange County court and plead Client to a DUI in that case. As a result of a loophole related to prior convictions and the timing of Client’s pleas, Client does not have to serve the otherwise mandatory jail time, or the additional 15 months of a DUI program.

Disposition: After negotiation, probation was reinstated with the same original conditions. Client was not sanctioned and no further punishment was ordered.

Client arrested for: Felony possession of narcotics + enhancement for use of a deadly/dangerous weapon.

Case notes: Client accused of unlawfully possessing 30+ vicodin pills, while also being armed with a switchblade. The enhancement for the switchblade would have added on a 1 year jail term to run consecutively to any jail ordered for the pills.

Disposition: After negotiation, enhancement dismissed and Client receives deferred entry of judgment (“DEJ”). As a result, case later dismissed.

Client arrested for: Misdemeanor driving on a suspended license b/c of a DUI conviction + a prior conviction for the same.

Disposition: After negotiation, prosecution agrees to drop the charge and strike the prior conviction. Client pleads to just an infraction for unlicensed driving. Jail time avoided; no jail time or community labor.

Client arrested for: Felony DUI w/ injury + excessive BAC enhancement.

Case Notes: Client accused of driving vehicle into a head on collision with another motorist while under the influence after driving down the wrong way of the freeway at a speed exceeding 50 mph. Both cars totaled. BAC alleged to be .18%. Other motorist suffers numerous injuries including head trauma, broken pelvis, and broken leg.

Disposition:After negotiation, Client pleads no contest to a standard misdemeanor DUI (without injury). No jail time; 20 days community service.

Client arrested for: Felony identity theft.

Case notes: The degree of financial injury alleged by the alleged victims was in the thousands of dollars range. It is important to note that any identity theft conviction will have severe consequences on a person’s ability to find or retain a job. Thus, it is a priority in these kinds of cases to prevent or mitigate such potential consequences to my clients.

Disposition: After negotiation, over the objection of the prosecutor, the court agreed to dismiss the charge through a civil compromise. Civil compromise was subsequently completed, and the identity theft charge was subsequently dismissed.
